Premises Licence
What is a premises licence?
This is a licence granted to a premises for one or more of the following:
- Sale and supply of alcohol for consumption on or off the premises
- Provision of regulated entertainment
- Provision of late night refreshment (provision of hot food and/or hot drink between 11pm and 5am)
Once issued this licence remains valid for the life of the business unless the licence is surrendered by the Licence Holder or revoked or suspended by the Licensing Authority.
There is an annual fee for this licence.

Failure to pay the premises licence annual fee will result in the Premises Licence being suspended.

You must now advertise your application in accordance with the Licensing Act 2003 (Premises licences and club premises certificates) Regulations 2005 Regulation 25 and 26. The application must be advertised for a period of no less than 28 consecutive days starting on the day after the day on which the application was given to the relevant licensing authority by displaying a notice which is:
- A. Of a size equal to or larger than A4
- B. Of pale blue in colour
- C. Printed legibly in black ink or typed in black font of a size equal to or larger than 16
In all cases the notice should be prominently displayed at or on the premises to which the application relates where it can be conveniently read from the exterior of the premises and in the case of premises covering an area of more than 50 metres square along the external perimeter of the premises abutting any highway.

The notice must also be published:
- In a local newspaper or if there is none, in a local newsletter, circular or similar document.
- On at least one occasion during the period of ten working days starting on the day after the day on which the application was given to the relevant licensing authority.

Will tacit consent apply?
Yes. After the 28 day consultation period has expired, if no representations have been received from Responsible Authorities or interested parties, then the licence is granted as applied for. We will issue the licence shortly after.
If there is a representation from a responsible authority or interested party then this will cause the application to be considered by the Licensing Sub Committee. A hearing will be arranged within 56 days from the date the application is made.
Apply to vary a premises licence
There may be a reason why you wish to vary a premises licence, such as to include further licensable activities or alter existing activities and operating times allowed by the premises licence.

Will tacit consent apply?
Yes. After the 28 day consultation period has expired, if no representations have been received from Responsible Authorities or interested parties, then the licence is granted as applied for. We will issue the licence shortly after.

Apply for a minor variation to a premises licence
This process can only be used where the variations will not adversely impact on the promotion of any of the four licensing objectives (prevention of crime and disorder, public safety, prevention of public nuisance, protection of children from harm).

Will tacit consent apply?
Yes. If after the 10 working day consultation period has expired and no representation have been made by a responsible authority or interested party, then we will approve the minor variation.
If any representations have been received, we have a further five working days to consider them and will decide whether to approve or reject the application.
If the minor variation is approved, we will issue a notice outlining the minor variation to the premises licence or club premises certificate. We will also issue a new licence or certificate to reflect the minor variation.
Notification of an interest in premises
If you have an interest in a premises under the 2003 Act you can apply to the appropriate Licensing Authority to be kept informed of any changes to the register of premises kept in accordance with section 8 of the Act. This notice has effect for a period of 12 months beginning the day it is received by the Licensing Authority.
